Terms of Service

1. Acceptance of Terms

By accessing or using ZaoHub ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including farmers, buyers, and visitors.

ZaoHub reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Account Registration and Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts to use the Platform.
  • You must provide accurate, current, and complete information during registration and keep your account information updated.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • Farmers must complete verification to list products. ZaoHub reserves the right to verify identity and farming credentials.

3. Platform Services

For Farmers

  • • List agricultural products for sale with accurate descriptions, pricing, and availability
  • • Receive direct payments from buyers through our secure escrow system
  • • Access market analytics, pricing information, and buyer network
  • • Manage inventory, track sales, and receive payment notifications

For Buyers

  • • Browse and purchase agricultural products directly from verified farmers
  • • Access requires an active annual subscription (KES 10,000 + VAT)
  • • Set up recurring subscription orders for regular produce purchases
  • • Access quality guarantees, dispute resolution, and delivery tracking

4. Fees and Payments

Buyer Subscriptions

Buyers must maintain an active annual subscription (KES 10,000 + 16% VAT) to make purchases. Subscriptions are non-refundable except as required by law or at ZaoHub's discretion.

Farmer Commissions

ZaoHub charges a commission fee (default 10%) on each successful sale. The commission is calculated on the sale amount before VAT and is automatically deducted from payments. Farmers receive the remaining amount (typically 90% of the sale) after commission.

Payment Processing

  • • All payments are processed through secure third-party payment providers (Co-operative Bank)
  • • Buyer payments are held in escrow until delivery confirmation
  • • VAT (16%) applies to all digital services as per Kenyan tax regulations
  • • Payment processing fees may apply and are disclosed at checkout

5. Product Listings and Sales

  • Farmers must provide accurate product descriptions, quantities, pricing, and quality specifications
  • Minimum purchase quantities apply (typically 25% of listed quantity)
  • Once a purchase is confirmed, farmers must fulfill orders as described and within agreed timeframes
  • Buyers must inspect products upon delivery and report discrepancies within 48 hours

6. Prohibited Activities

You agree not to:

  • List fraudulent, misrepresented, or illegal products
  • Engage in price manipulation or collusion
  • Circumvent platform fees or payment systems
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations

7. Dispute Resolution

ZaoHub provides a dispute resolution system for transaction issues. Users must attempt to resolve disputes through the platform before seeking external remedies. ZaoHub may facilitate resolution but is not responsible for final outcomes.

Disputes must be reported within 48 hours of delivery. ZaoHub will review evidence from both parties and may issue refunds, partial refunds, or other resolutions as appropriate.

8. Limitation of Liability

ZaoHub acts as an intermediary platform and is not responsible for product quality, delivery, or transactions between users. Our liability is limited to the commission fees we collect.

ZaoHub is not liable for indirect, incidental, or consequential damages arising from platform use or transactions.
